Rafał Hajduk is a partner and the head of the energy team at the Warsaw office of Norton Rose Fulbright. For the last 19 years he has been working almost exclusively for the energy industry and on energy related deals. His experience covers all types of energy sector work and may be divided into the following categories: • energy industry regulation including in particular licensing, energy tariffs, TPA, unbundling of system operators, renewable energy and cogeneration support schemes, access to cross-border connections, termination of long-terms PPAs, regulatory disputes, EU directives implementation, various regulatory aspects affecting crude oil imports and trading as well as trading in oil products; • greenfield projects in the energy sector, in particular construction of new electricity capacity (both coal and gas fired) as well as wind farm projects (advising sponsors of projects on all aspects of project development including in particular regulatory issues and all contractual arrangements necessary for the successful closing of projects); • M&A in the energy sector, including in particular privatization of power plants and electricity distribution companies and several acquisitions in the oil sector; • energy trading: legal advice on regulatory and contractual issues in electricity, gas, emission allowances and oil trading as well as derivatives based on those commodities. Rafał Hajduk is retained as the official Polish legal counsel by EFET (European Federation of Energy Traders). He was instructed by EFET to draft an opinion on the enforceability of EFET electricity, natural gas and allowance trading agreements under Polish law and to draft the Polish versions of EFET electricity and emission allowance purchase agreements. He also advises the Polish Association of Energy Trading. He is ranked and highly recommended as a ‘leading individual lawyer’ and ‘key individual lawyer” in energy by Chambers and Partners Legal Directory and Legal 500. Rafał Hajduk won the International Law Office Client Choice Award for the years 2012, 2014 and 2015 in the category Energy&Natural Resouces: Poland. Rafal Hajduk has written a number of publications on regulation of the energy sector and investments in the energy sector.
